Stamp duty exemptions and reliefs

A nil bill, an exemption and a relief can have different implications for your tax return.

Three different reasons for a £0 bill

A purchase can sit within a nil-rate band, qualify for a relief that reduces tax, or be exempt under a specific rule. The tax amount may look the same, but the filing obligations can differ. A calculator’s £0 output is not confirmation that no return is required.

For example, a first-time buyer may need to claim relief on a return even though no SDLT is payable. A separate exemption may remove both the tax and return requirement if all its conditions are satisfied.

Gifts and inherited property

Property received under a will and transfers for no money or other consideration can fall within exemptions. However, “no cash paid” does not always mean “no consideration”. Taking over mortgage debt can make an apparent gift a chargeable transaction.

Record the actual debt and payment arrangements before deciding. An inherited interest may also affect first-time buyer or additional-property treatment on a later purchase, even if the inheritance itself did not generate SDLT.

Reliefs must fit the buyer and transaction

First-time buyer relief is a common residential example. Other reliefs exist for specific situations such as qualifying charitable or group transactions. Their availability should not be inferred from a buyer’s name or broad purpose alone.

Our calculators apply the first-time buyer setting you select; they do not assess specialist reliefs. Multiple Dwellings Relief has been withdrawn for SDLT subject to relevant transitional provisions, so older online examples can be misleading.

Avoid treating a tax estimate as an eligibility certificate

Ask your adviser which provision applies, which conditions must be met and whether a return or relief claim is required. Preserve supporting evidence with the purchase documents. If a condition later changes, ask whether that can affect the relief.

These are SDLT examples for England and Northern Ireland. Scottish LBTT and Welsh LTT have their own exemption and relief rules. A relief available in one jurisdiction should never be assumed available in another.
